NCPA LEGAL UPDATE February 2012 If an employee makes a false sexual harassment complaint as a diversionary tactic to avoid discipline for misconduct, can the employer terminate the employee for making the complaint, or is the employee protected against “retaliation” under state or federal anti-discrimination laws? A California appellate court considered that question in a case titled Joaquin v. City of Los Angeles.
